On July 11, 2013, the Supreme Court had ruled that an MP or MLA would be disqualified from the date of conviction by the trial court. The court gave this order in the case of Lily Thomas vs. Government of India. Earlier, there was a provision not to terminate the membership of the MLA or MP until the final decision of the court.
It is being told that Rahul Gandhi’s team will now challenge the decision of Surat court in the High Court. If the appeal against the Surat court’s decision is not accepted there, then an appeal will be made directly in the Supreme Court.
In fact, Rahul Gandhi was given 30 days to file an appeal against the Surat court’s decision. Rahul Gandhi’s lawyer also said that we will go to the High Court against the decision. But so far, rahul has not appealed in the High Court.
