Bhopal gas victims won’t get additional Rs 7,800 crore compensation, plea dismissed

The Supreme Court has dismissed the central government’s curative petition to increase the compensation of the victims of the Bhopal gas tragedy. The petition had sought additional compensation of about Rs 7,800 crore from Union Carbide to the gas victims.

A bench of Justices Sanjay Kishan Kaul, Sanjiv Khanna, Abhay S Oak, Vikram Nath and J K Maheshwari said reopening of the cases will increase the hardships of the victims.

Let us tell you that the Central Government had filed a curative petition in 2010. On January 12, 2023, the Supreme Court reserved the verdict. The government had argued that the victims cannot be left in the lurch.

In fact, after the gas scandal, Union Carbide Corporation had given compensation of $ 470 million (Rs 715 crore) to the victims, but the victims appealed in the court demanding more compensation. The Centre has sought an additional compensation of Rs 7,844 crore from Dow Chemicals to the victims of the 1984 gas tragedy. For this, a curative petition was filed in the Supreme Court in December 2010.

On this, the Supreme Court said in its decision that the burden of more compensation cannot be imposed on Union Carbide Corporation. We are disappointed that the government did not pay attention to it for two decades. The victims have been compensated almost 6 times more than the loss.
The central government should use the Rs 50 crore lying with the RBI according to the needs of the victims.
If this case is reopened, it will be beneficial for Union Carbide, while the difficulties of the victims will increase further.
