Supreme Court dismisses opposition’s plea seeking separate guidelines

New Delhi: The Supreme Court on Tuesday dismissed a petition filed by 14 opposition parties over the arbitrary use of central agencies like the CBI and the ED. A bench headed by Chief Justice DY Chandrachud said during the hearing on Wednesday that a separate guideline cannot be made for politicians. In fact, the opposition parties withdrew their petition after this comment of the court.

Let us tell you that 14 opposition parties led by The Congress had accused the central government of arbitrary use of CBI and ED. In the petition, these parties had demanded the issuance of new guidelines for leaders regarding arrest, remand and bail. On this, CJI Chandrachud said that when you say that the importance of the opposition is decreasing, then the treatment is in politics and not in the court. The CJI said it would be dangerous for the court to issue general guidelines in the absence of facts.

Senior advocate Abhishek Manu Singhvi argued on behalf of the opposition parties. Singhvi said in the petition that from the year 2013-14 to 2021-22, there has been a 600% increase in the cases of CBI and ED. The ED examined 121 leaders, 95% of whom are from opposition parties. The CBI investigated 124 leaders, of which more than 95% are from opposition parties.

On this, the Supreme Court asked Singhvi, “Can we say because of these figures that there should be no investigation or litigation?” Could this be the reason for the rescue? The court said that the leader of a political party is basically a citizen and as citizens we are all subject to the same law.
