A court in Gujarat’s Surat on Thursday convicted Congress leader Rahul Gandhi in a criminal defamation case filed against him in 2019 for his remarks on “Modi surname”. The court has sentenced Rahul Gandhi to two years in jail. However, the court immediately granted bail to Rahul Gandhi on a bond of Rs 15,000 and stayed his sentence for 30 days so that he can challenge the decision in a higher court.

The court of Chief Judicial Magistrate H H Verma convicted Congress leader Rahul Gandhi under sections 499 and 500 of the Indian Penal Code, his lawyer Babu Mangukia said. These sections relate to defamation and related punishment. According to the Representation of the People Act, a person sentenced to imprisonment for two years or more will be disqualified “from the date of conviction” and will remain ineligible for six years to become a public representative after completion of his sentence. Rahul Gandhi was present in the court when the verdict was pronounced.

The case has been filed against Rahul Gandhi for his remarks that “why all thieves have the same surname Modi?” Gandhi, a Lok Sabha member from Wayanad, made the remarks at a public meeting in Kolar in Karnataka ahead of the 2019 general elections.
