The Rajasthan High Court will hear on January 16 the resignations of 91 MLAs supporting Chief Minister Ashok Gehlot. The case was heard by the Chief Justice of India in the Jaipur bench of the Rajasthan High Court on Monday. The High Court has asked the Advocate General to explain the time frame for the decision to be taken at the speaker’s level on the resignations of mlAs.
The high court gave these directions while hearing a petition filed by Deputy Leader of Opposition and BJP leader Rajendra Rathore in the Assembly. The High Court has refused to keep the issue pending indefinitely. The high court has also refused to allow advocate PC Bhandari to become a party in the case.
In the last hearing, the Rajasthan High Court had issued notices to the Speaker and the Assembly Secretary on the resignations and sought their response. On Monday, the Advocate General sought time to submit a reply to the petition. A division bench headed by the Chief Justice refused to keep the matter pending indefinitely and asked it to inform the decision within the next 10 days. The court listed the matter for further hearing on January 16.
Deputy Leader of Opposition Rajendra Rathore said the matter was pending before a division bench of the Chief Justice as the resignation of the 91 MLAs was not decided for 97 days. This will be the first time in the parliamentary history of Rajasthan that the Speaker has been directed from the court. Rajendra Rathore questioned how the salary taken and benefits taken by 91 MLAs for 97 days will be compensated.
Rajendra Rathore himself filed a petition in the High Court on December 1 after the resignation of MLAs supporting Gehlot on September 25. Since then, the matter has been on the rise.
